Volunteer / Intern Placement Services Agreement : Disclaimer & Limitation of Liability

The following terms and conditions are an agreement between you and Volunteering Travel Solutions Pvt. Ltd.. When you make an application for a Volunteering Travel Solutions Pvt. Ltd. service, you are agreeing to what is stated below.

By applying to volunteer with Volunteering Travel Solutions Pvt. Ltd., you would agree to the following terms:

Lodging

Food

Insurance: All participants need to buy full comprehensive medical insurance for their time of stay in our project. Please ask us for details at info@volunteeringsolutions.com for more details on how to buy Insurance from Volunteering Solutions. The Insurance is provided by a third party vendor and Volunteering Travel Solutions Pvt. Ltd. does not take any responsibility towards claims or disputes with the Insurance provider with the client.

Payment and application process

Once we receive your application along with your application payment of US$200 we will process your application within 10 days of application. We will send you a written confirmation of you application by e-mail and details of your placement would be uploaded in your MyAccount section of the website. In certain circumstances which are beyond our control it could sometimes take a little longer than 10 working days. It is the volunteers responsibility to check their MyAccount section for updates on the trip. Volunteering Solutions cannot be held responsible for e-mails going in the volunteers Junk/Spam folder in such cases.

Cancellation and Refund Policy

Refund of Application Fee

Application fee is refundable upto only 90 days before the program start date (please see details below). Refund requests must be received ninety (90) days prior the the program start date through written confirmation. Upon receipt of the request the volunteer will be notified immediately via email. If the volunteer does not receive confirmation they should assume that the request has not been received. The application fee amount of $200 would be refunded less the administration charges of $35 which would cover bank charges and currency conversion charges regardless if the placement has been sent or not.

Please Note the following rules about the 90 day refund policy given below:

- Application fee will not be refunded under any circumstance if the volunteer cancels within ninety (90) days of program start date, regardless if the placement has been sent or not.

- Participants applying within 90 days from their program start date will not receive any refund of application fee whatsoever.

- Application fee will NOT be refunded once the Placement is confirmed by Volunteering Solutions even if it falls before the 90 days before program start date.

Under the rare instance where Volunteering Travel Solutions Pvt. Ltd. is not able to provide a suitable placement to the client. We will be deducting $35 as administration charges from this refund amount. (Does not apply to 90 days notice)

Refund of Program Fee

Cancellation of volunteer program by client: Volunteering Travel Solutions Pvt. Ltd. incurs a lot of charges in order to provide placement to the client. If someone cancels the program after payment of program fee 60 days prior to departure, we would refund 70% of the program fee only. Cancellation 30 days prior to start date, the client would be refunded with 50% of the program fee only & any cancellation done within 30 days of the program start date, the client will not receive any refund what so ever.

In all the above circumstances pertaining to program fee refunds, Application Fee would NOT be refunded to the volunteer.

Cancellation after Project start date:- Under no circumstances will the program fee be refunded to the client. Application fee of US$200 will also not be refunded.

Cancellation by Volunteering Travel Solutions Pvt. Ltd.:- Incase Volunteering Travel Solutions Pvt. Ltd. has to cancel the clients project due to certain natural and unnatural circumstances Volunteering Travel Solutions Pvt. Ltd. will refund part of the remaining time period of the project fee calculated on a pro-rata basis excluding the application fee of US$200 and 7% (seven percent) bank charges.

Payment of refunds: - Volunteering Travel Solutions Pvt. Ltd. will refund the applicable refund amount to the client within 100 (one hundred) days of confirmation of cancellation.

Volunteering Travel Solutions Pvt. Ltd. would not provide any compensation whatsoever for any of it's programs.

Use of Photos and Feedback

By agreeing to the terms and conditions you agree that Volunteering Travel Solutions Pvt. Ltd. can use your photos and written feedback while at the project to post on its website www.volunteeringsolutions.com Volunteering Travel Solutions Pvt. Ltd. might use such material for marketing/promotion in form of brochure/emails/ or on its website. Volunteering Travel Solutions Pvt. Ltd. also uses photos and material from our partners and affiliations abroad and in India and is not responsible for a claims arising towards that material/photos/content. This includes photos and videos posted on our Facebook page and other social media network sites.

Personal Risks

The volunteer acknowledges and accepts the responsibilities and risks associated with their agreement to travel to, temporarily live in and provide volunteer services in a developing country. Such travel and volunteer work can be often hazardous and involves a certain degree of risk, inherently dangerous activities and personal perils to the volunteer, both foreseen and unforeseen, all of which are fully accepted by and solely assumed by the volunteer. Therefore, Volunteering Travel Solutions Pvt. Ltd. including any and all of its employees, managers, directors, shareholders, host families and host country partner organizations are not liable, to the maximum extent of the law, for any loss or harm the volunteer or associates may suffer, including but not limited to loss caused by:

- Personal injury

- Emotional injury

- Death

- Illness or disease

- Damage to or loss of property

Seizing the agreement

Volunteering Travel Solutions Pvt. Ltd. will end this agreement with you in case of following reasons:-

If we find that you are engaged in any illegal activities or convicted of any criminal activities before or during the Project Period
If it is believed that any of your action or behavior is threatening or unacceptable to the society or any one involved with the project based on the judgment of the project staff and/or the in country coordinator.
Any information provided by you to Volunteering Travel Solutions Pvt. Ltd. during the time of enrollment is incorrect.
You voluntarily decide to opt out of the program in between.
If you are found taking drugs or using such material while in the project.
If you are found to be engaged in sexual behavior while your stay in the host family.
If you do not observe the Code Of Conduct in your host country.
In case the agreement is terminated due to any of the above reasons or reasons relating to the above, you will not be entitled to any refund from Volunteering Travel Solutions Pvt. Ltd.

Volunteering Solutions has the right to cancel any placement of an enrolled volunteer before start date.

DISCLAIMER

A. User expressly agrees that use of Volunteering Travel Solutions Pvt. Ltd. is at user's sole risk. Neither Volunteering Travel Solutions Pvt. Ltd., its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that Volunteering Travel Solutions Pvt. Ltd. will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of Volunteering Travel Solutions Pvt. Ltd., or as to the accuracy, reliability or content of any information, service, or merchandise provided through Volunteering Travel Solutions Pvt. Ltd..

B. Volunteering Travel Solutions Pvt. Ltd. is provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.

C. In no event will Volunteering Travel Solutions Pvt. Ltd., or any person or entity involved in creating, producing or distributing Volunteering Travel Solutions Pvt. Ltd. or the Volunteering Travel Solutions Pvt. Ltd. software/content, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use Volunteering Travel Solutions Pvt. Ltd.. User hereby acknowledges that the provisions of this section shall apply to all content on Volunteering Travel Solutions Pvt. Ltd.

D. Volunteering Travel Solutions Pvt. Ltd. does not take any direct responsibly for the use of third party online payment facility. HDFC Bank / PAYPAL will not be responsible for any malfunction in their software for online payment. All disputes arising with Credit Card fraud will Directly be dealt with HDFC Bank or PAYPAL (Depending on the payment method you used for Payment).

E. In addition to the terms set forth above, neither Volunteering Travel Solutions Pvt. Ltd., nor its affiliates, information providers or content partners shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within Volunteering Travel Solutions Pvt. Ltd., or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. Neither Volunteering Travel Solutions Pvt. Ltd. nor its affiliates, information providers or content providers warrant or guarantee the timeliness, sequence, accuracy or completeness of this information. Additionally, there are no warranties as to the results obtained from the use of the information.

F. Volunteering Travel Solutions Pvt. Ltd. will only deal with any disputes or charges in India and is governed by Indian Law. All copyright issues including others will only be dealt in Indian court of Law. All disputes and cases will be solved in New Delhi, India only.

G. Volunteering Travel Solutions Pvt. Ltd. does not take any responsibility of photos and documentation provided by our partners and affiliations abroad, who might supply such material to other businesses of similar nature as well. If anyone has any objection to any part of the site, will write to us formally, for us to take appropriate action.
